Habba's term was set to expire this week, and federal judges in New Jersey had moved to appoint someone else to the position.

Mikie Sherrill's running mate, Dale Caldwell, has connections to the charter school movement and worked under former Gov. James McGreevey.

It comes after a panel of federal judges in New Jersey declined to extend Habba's term as the state's interim top prosecutor.
